NEW GOVERNING CONCEPT

OF DEMOCRATIC SOCIETY

The introduction to the 21st century started with the economical aggression of the free enterprise to dominate the world market. Large industrial conglomerates were merging capital to seize more political powers using the concept of free trade. World governments accepted free trade as a solution to avoid temporary economical crises and politically gain credits for rejuvenation of business with the third world countries. As a consequence, all involved countries in the free trade are depending on a foreign market, which is destroying home industry, increasing cost of living and is demoralizing the labor force .

To avoid complete bankruptcy of the nation at the first decade of this century, we will need to restructure the governing concept of our societies.

As we can observe from the history, human population can survive war defeats, starvation and mental cruelty only with the hope for better living in their establishment. But the society could be destructive to their own existence without the hope, strong ideology and morals.

The dilemma of these internal conflicts is in between the ideology ( representing social statues , morals and ethics – versa the justice of law ) and the economy ( representing industrial capabilities with a capital surplus – versa of social needs of population ).These contradicting issues are presently in control of the same one government, who always has a self-conflicting interest.

Is it the corruption and blindness of our leaders, or is it our intelligence, science indifference and conservative culture which is keeping us all blind and incapable of progressive actions to acknowledge our degrading social structure of living ? Are we afraid to loose our technical advantage and comfort? ….

We will need to restructure the governing of our society to save our civilization. Presently some European nations and Canada should considering such options. These changes should appear at two levels of societies existence:

1/ nationally and 2/ globally

a/ bureaucracy should be removed a/ ideology of life should be reconstructed

b/ public morals should be reinstated b/ high education & research should be emphasized

c/ small industry should be rejuvenated c/ free trade should be changed to the nations

cooperation

1/ Nationally - the necessity call to:

1/ decentralized the government

2/ decompose the parliament and senate into : a/ political chamber

b/ economical chamber

3/ elevate values of human equities

GOVERNING STRUCTURE

Governing powers should be divided into four levels according to sovereignty of territories. All country laws should be initiated from the lower level of governments and be presented to legislation to upper levels. It is expected, that parliament will have a leadership quality and will formulate new laws in a spirit of a new ideology.

LEVEL #1 - The FEDERAL / National Parliament

The responsibility of the Federal Government will be concentrated on national unity. It will provide management of human and natural resources and will protect democracy through a national policy. The Federal Parliament must have an equal representation across the country in both chambers : Political and Economical ( see: Provincial Parliament ). The members will be nominated for 2 years from the Provincial chambers. This regulation will guarantee, that nominee will represent ideology of leading political parties and interest of the provincial economy.

Federal Government should operate with only three ministries

1/ Ministry of National SECURITY & JUSTICE

External and Internal securities will be provided by the army and the police. Recruitment will consist from – 60% permanent professional and from 40% temporary militia members recruited for 2 years term from the able unemployed with a proper training.

The Justice system must represent nations traditional cultural formulas of social co-existence versa other cultures. It is up to the government to formulate and reflect within new laws the vision of new ethics and bare responsibility for future consequences. ( Let’s review some conflicting issues: same sex marriages, use of drugs and narcotics, converting crimes into a punishment and re-instating death penalty for mass murderers, use of prisoners’ labor force to pay for victims re-imbursement and jail expenses, religious aggression, discrimination creating racism, child protection, euthanasia…. )

2/ Ministry of FOREIGN AFFAIRS, - REVENUE, - FINANCE

Division of Foreign Affairs - Basic democratic philosophy in foreign policy will guarantee no interference to the cultural / political maturity process of other nations development. Any trade co-operation of goods should be with the countries of equal economical level, without the taxpayers’ subsidy.

Foreign Landings/Loans should have a budgetary ceiling and short repayment terms. Economical help to foreign countries in state of emergency will represent export of technically and financially equipped specialist ( no cash - to avoid corruption and fraud ). Immigration quotas will be temporary reduced to a highly desirable professional workers on a private sponsorship only.

Land is not sellable to foreign investors, but for long term lease.

Division of Revenue - will have operational control and collecting responsibility over the national tax revenue system. Collected revenue will be distributed by the suggested formulas to remaining levels of the governments : Federal Revenue – will be generated from the business foreign tax, from the public registered companies tax revenue, from interest of business loans and from various financial transactions plus from 20% total collected personal income tax..

Provincial Revenue – will be generated from local businesses & industries tax, from provincial energy industries tax plus 25% from collected personal income tax.

Regional Revenue - will be generated from natural resources ( farming, fishing, forestry ) from leases of the crown land plus 55% from collected personal tax outside of the cities.

Cities revenue – will be generated from 55% collected personal income tax and property tax within the city.

We do not need big governments, doubling their functions on each level, but a proficiency one fully responsible within their jurisdiction to provide public services and leadership. Changing revenue formulas will require 4 years waiting period and public consent. There should not be double taxation.

Division of Finance – will control banking, currency, insurance and stock market.

Every government loan to large businesses should not exceeding 35% of total company assets and should be secured by the Company voting shares with a guaranteed profit and interest.

If the company productivity & capital indicates shares value, than dividends are rewards to investors. Cash out dividends as a return on a private loan / investment to a company should not annually exceed multiple rate of 2.75 times prime rate of National Bank. This regulations will keep inflation price of products in a very modest raise and it will change quantity production to a quality ( providing adequate staffing, expertise and working environment ) It will shift more company capital to the re-investment and research. Rules of stock-market shares will apply for all financial industry .

3/ Ministry of HEALTH,- WEALTH, - EDUCATION,

Division of Health - should provide a mandatory Life Security Plan ( merging existing UI, Life insurance & Long Term Disability with the Pension Plan insurance ) for each citizen.

From the day 1, the government will open individual account for each new born citizen and will deposit to the common fund one time sum equal to amount of 6 months UI benefit . With an accumulated interest over the life span and regular pre-payments from insured and employees, it will provide beneficiaries with adequate future securities .

Hospitalization & Medicare should be free of charge for all patients. Medication and Short Term Disabilities Insurance Plan payments would be covered from 70% by the Government , from 15% by the employer and 15% by patient or private insurance.

Division of Wealth - Unemployment Insurance will be merged with the Personal Life Security Plan. The Unemployment benefit will be paid from Federal funds for a maximum of 6 months ( 75% of a stipulated minimum rate ). After this term, under the Provincial Jurisdiction each unemployed will have the obligation to take free professional upgrading courses and the job placement or alternatively to enroll to the militia . Extended Unemployment will be paid up to 2 years for maternity , sickness recovery or upgrading study.

Division of Education - Basic Education while compulsory must be free of charge, High Education ( universities + colleges ) can establish for students environmental annual fee equal to 2 months of minimum wage salary. Basic education must absorb in the curriculum : logistics, philosophy , morals and ethics. Esthetics of Fine Arts and Literature should be taught as a higher level of philosophy. During the college practicum, apprentices salaries in all professions will be sponsored from 50% by the province and 50% by employer.

LEVEL #2 -The PROVINCIAL Parliament

Representatives to Provincial Parliament ( to Political and Economical Chambers ) will be elected by public vote for the 4 year term. On a voting list would be :

1/Candidates to the Political Chamber from major political parties representing different ideologies of the future society web.

2/ Candidates to the Economical Chamber, politically independent professionals from different trades and associations.

3/ Candidates for provincial Premier / Members of both chambers will select 2 nominee.

4/ Candidates for the State President, Vice-President and State Secretary. All these candidates will chair the Federal Parliament and therefore should be able to distant themselves from all parties operations.

5/ Included will be vote for five volunteering members to the Advisory Board of Directors on the Provincial and Federal level with the mandate to evaluate co-operations between both chambers and to supervise working ethics of executives in the governments. ( Function of General Governors would be abolished.)

Public election to all government levels will be held only on the provincial level.

20% members of the Provincial Parliament will be delegated to the Federal Parliament.

If we want to exclude from the governing body a greed of power, egoism, and corruption , than all parliament members should be placed on the public salary grid with no exception in taxation, pension or medical treatment. Any high public position should not be a profitable employment, but honorable statute with dedication to patriotism and humanity. All members must share a necessary experience to live in the grass-root society. For a better public control , all Government Departments should operate within collected revenue from their jurisdiction areas, but having properly in order the priority services.

Provincial government is the engine of the state economy. If the provincial government will need to enlarge it’s budget, it will need to enlarge the business base and create the business independence from imported goods. Both chambers of parliament should have equal representation by the population in ratio : 1 delegate from each chamber for approx. 150,000 citizens.

Provincial government has to control its operations through the three ministries:

Ministry of Business & Industry

Ministry will co-ordinate small business activities under the same federal policy for business loans and taxation. Provinces should promote export of home products and market independence from the import of daily goods . Province should support local factories to compete in quality with such product. The province should promote and establish a secondary industry which will mend a raw natural material and will not allow export it unless its from 50% in a preparation stage. Ministry will provide supervision over the small Business, Energy, Food , Tourist industry and a Research.

Ministry of Communication & Arts

Ministry will provide supervision and full financial support to Radio, TV, Professional Symphony Orchestra, Ballet , Opera , Theatre , Museum & Exhibitions . They will be 100% provincially budgeted and their performances will represent provincial living standard. They should be accessible in price to each citizen as an on-going public upgrading education program. Ministry will control Post delivery operation and HWY roads, Transportation by Land , Water and Air traffic.

Ministry of PUBLIC SERVISES & LEGAL

Will provide capital investment and supervision over the needs of seniors, unemployed, special schools and pre-school children. Same will apply to local security, civil courts of justice and prisons.

Provincial Ombudsman-Board of Directors should supervise living and working standard of population and should report problems to legislators..

The largest danger of the society would come from giant corporations, who with constant merging are gaining unlimited financial and political powers. The infrastructure of these giants is hold together by inner bureaucratic rules, fears and corruptions, damaging human equity mentally and physically. Social functions of these conglomerates should be revised. One should not discriminate individuals by the race, gender , age or by social statute.

Workers should be rated by their knowledge and experience (enclosed tables of income and tax samples are calculated on 2002 living expenses.) Social Services dept. should function as human resources. They should offer employment and be responsible to investigate and solve chronically unemployed and homeless cases. We should eliminate a human poverty.

LEVEL #3 - REGIONAL GOVERNMENT :

Three Regional representatives elected for 4 year term are 3 chairmen of each department. Each department should have elected Citizens Advisory Board of Directors.

Department of Environment – have to set the standard environmental policy and control pollution outside and in the cities. Must control storage of toxic materials and provide plan of up-keeping of natural resources and their production limits.

Department of Emergency & Planning – is responsible for secondary roads, rivers & lakes, commercial and public suburban planning and development. Must have a plan and resources for the life emergency due to nature or terrorists disaster elements.

Department of Ombudsman & Multiculturalism - A multiculturalism will be practiced in private ethnical clubs, simile as any other amateur’s local arts & sport clubs. Same will apply to religious organizations. All activities would be privately funded and considered as self – served interest groups. Ombudsman’s office & Public Advisory Board will investigate complaints, supervising legal and accounting procedures.

CITIZEN’S CHARTER OF RIGHTS : -

Representation of personal freedom in a democratic society is guided by public morals, by the leading national philosophy and by the law-full protection of the human society. The evaluation of anybody behavior should be made in reflection of the present and future consequences. Charter for each citizen means not an academic formula, but a practical approach to accept personal freedom under the consideration of self discipline not to harm other individual or part of society financially, physically and morally. Those who violate the charter should be stripped under the criminal law of such humanitarian privileges.

Minority groups, aboriginals, immigrants will have equal rights with the citizens to collect society benefits if they accept Citizens Charter of Rights with the responsibilities to pay tax and Life security insurance. Only the third generation of immigrants may be elected to the public functions.

LEVEL # 4 - CITY/ VILLAGE - DEPARTMENTS :

All cities, villages are the nation’s human resources. Their management mandate is to care for quality life of each citizen. They should have an input and negotiating powers with the provincial and regional government to provide the best physical and spiritual living standard for citizens. Taxpayers should have a rights to shift their tax money from one project to another one by their priority on a tax payers’ form.

The major and alderman are publicly elected for 5 year term. Full time representatives will chair each operating department. Each Department should have volunteering Advisory Board of Directors.

Department of Development – is responsible for licensing, urban planning, business development,

City transport,

Department of Civilization - control standard of living, areas of recreation & culture ,

communication, supplementary education, unemployment programs,

Department of Ombudsman - investigating complaints re: city and other level of governments,

supervising legal and accounting procedures.

SOCIAL WEB STRUCTURE :

Before we would consider a globalization theory, we have to re-organize the social structure of our society and establish economically independent self supplied conditions. The general concept of a government organization should be constructed on a principal to exist from the restricted revenue paid for public services. Therefore cost on duplication of services should be eliminated. If the quality of services would increase , than public demand will consequently increase the budget revenue. Surplus would be accountable to the programs improvement.

EXAMPLES :

The Provincial SCALE of PERSONAL INCOME – The difference of Personal Income between the categories of qualifications : should provide continuity through the highest payment of the lower category to the starting salary of the next higher category. Consequently the taxation should aim to a democratic equality of the same percentage ( see sample of category B & C ). Salaries should be calculated on hourly rate with seniority increments within each category . Calculation bellow is applicable to monthly salaries, based on 35 / 40 hours work per week: The seniors pensions will be calculated 1.8 x minimum wage plus inflation increases.( Figures are applicable to a living cost in the year 2002 )

Basic / labor $12.- Minimum wage [ should cover necessary expenses : food, personal, rent /

or 3.5x rental cost of bachelor suite ]

Educated labor $15.- up to $ 30.- / - plus annual inflation increase + bonus

Trades and certified workers - $25.- - “ $ 35.- “ “ “

College & University - $35.- - “ $ 45.- “ “ “

Specialist - $45.- - “ $ 50.- “ “ “

COMPANIES / INSTITUTIONS

- should void if possible a Part Time employment and pay over-time 1.5 times hourly rate.

- must pay for each worker (FT or PT in recalculated portion) whole package of Life Security

Plan, medical & medication insurance benefit.

- must pay to all workers ( including PT in recalculated portion ) statutory holiday and severance pay.

For the benefit of production, employers should develop a long term employment relation- ship with employees and give them incentives and responsibility for quality work. Employer should provide a likable working environment, solid future of long term employment with benefits and solid organization that they all can be proud of.

Any new reconstructed society structure is open to the danger of figure miscalculation

and should be introduced stage by stage to realization after the parliamentary ideological changes will be established, to avoid public misunderstanding and minimize fatal errors. The time is the essence of action to keep the democratic scenes in advance at the world leadership during the 1^st decade of 21 century.

Whom we will envy to become the 1^st proud nation which shows to the world a BALANCED DEMOCRACY ? ( balanced in between economy and ideology , in between a human factor and bureaucracy ).
